02 · Your data

Privacy policy

Marco Hesina is the controller responsible for processing personal data on this website. Contact details are provided in the Legal notice. For privacy enquiries, please contact office@marco-hesina.at .

Visiting the website

When you access the website, connection data such as your IP address, the time, the requested page or file and browser information are transmitted to the web server. Technical logs support operation, troubleshooting and protection against abuse. The legal basis is our legitimate interest in a secure, functioning website under Article 6(1)(f) GDPR. Recipients are the service providers engaged for hosting and technical support.

Fonts, images, audio previews and PDF files are served by this website. We use no advertising trackers or embedded social media feeds. Links to Instagram, Spotify and YouTube open the respective platform only when clicked.

Data-minimizing usage statistics

We count page views and selected actions on our own server, such as listening to beats, adding items to the cart, starting checkout, successfully sending contact enquiries and clicking external profiles. Only daily totals by page, language version, action and broad source category (such as search or Instagram) are stored. Full referral URLs, search terms, URL parameters, order identifiers, messages and form entries are not transmitted to the statistics system.

The statistics system sets no cookies, uses no browser storage and creates no visitor identifiers or usage profiles. Its database stores no IP addresses or browser identifiers. Technically, sending a counting request transmits connection data to the web server, as with any website request; the hosting logs described above are separate. No external analytics service is integrated.

Browsers with Do Not Track or Global Privacy Control enabled are excluded from counting. Daily values are considered for 90 calendar days; older values are deleted the next time the statistics report is opened or a counting request arrives. The purpose is to improve our offering using aggregate usage data. To the extent that personal data is processed during transmission, we rely on our legitimate interest under Article 6(1)(f) GDPR. You can object to counting through the browser settings mentioned above.

Contact and project enquiries

The contact form processes your name, email address, selected service and message so that we can answer your enquiry. The information is emailed to our office and copied to another GMX mailbox used by Marco Hesina. The respective email providers participate in transmission and storage.

For specific project or contract enquiries, processing is necessary to take steps prior to entering into a contract under Article 6(1)(b) GDPR. We handle other enquiries based on our legitimate interest in communication under Article 6(1)(f) GDPR. The information is required to process your enquiry through the form; alternatively, you can contact us by phone or email.

Spam and abuse protection

We use Cloudflare Turnstile, provided by Cloudflare, Inc., USA, on the homepage with the contact form and for administrator login. When the security check loads, data including your IP address, browser and connection signals, and the website visited are transmitted to Cloudflare. On submission, our server verifies the check result with Cloudflare.

This protects against automated requests and attacks on the basis of Article 6(1)(f) GDPR. Cloudflare processes the signals as a processor to protect us and under its own responsibility to improve its bot detection. Processing outside the EEA, particularly in the USA, is possible. Cloudflare describes the safeguards it uses, including the EU–US Data Privacy Framework and standard contractual clauses, in its Privacy policy. Details of data, purposes and rights are provided in the Turnstile privacy notice.

We also limit request volumes using hashed IP identifiers and time information. This processing also serves to prevent abuse under Article 6(1)(f) GDPR. Old entries are cleaned up on subsequent requests: after the 15-minute window for the contact form, and after 24 hours in the store. Hashed identifiers are not treated as anonymous data.

Orders, payments and digital delivery

We process your name, email address, billing details, selected beats and licences, price and tax data, order and payment identifiers, times, purchased terms, and your declarations regarding immediate download. This supports contract formation, payment verification, invoicing, contract confirmation and file delivery under Article 6(1)(b) GDPR, as well as legal obligations under Article 6(1)(c) GDPR. Session identifiers and private download tokens protect access; abuse prevention is based on Article 6(1)(f) GDPR.

For payments, we use Stripe Payments Europe, Limited, Ireland, and the Stripe entities responsible for the respective service. We transmit the order identifier, email address, items and prices; you enter your billing address, tax identifiers and payment details on Stripe's payment page. Full card numbers and card security codes are not stored on our server. Stripe processes data for payment processing, tax calculation, invoicing, fraud prevention and its own legal obligations, partly as an independent controller. Processing outside the EEA is possible; information about recipients and transfer safeguards is provided in the Stripe privacy policy.

For real purchases, we email the licence and delivery confirmation, licence terms, consent declarations and personal download link. For purchases marked Sold through Link, Stripe Managed Payments processes the transaction as merchant of record; Link sends the purchase and invoice documents and handles transaction-related customer enquiries. For direct purchases, Marco Hesina provides the invoice through Stripe. The hosting and email providers used participate in processing and delivery. Order data and necessary delivery information are stored on the server with access protection. Personal links provide access to files and documents; do not share them. A customer account is not required.

In explicitly labelled demo or Stripe test mode, no real payment takes place and no usage rights are granted. The same rules for protecting entered data apply to tests; use only test card details with Stripe.

Online withdrawal

When you use the withdrawal function, we store your name, email address, contract description, declaration, and the date and time of receipt. We acknowledge receipt by email and process the request. The legal bases are Article 6(1)(b) and (c) GDPR and, for security, Article 6(1)(f) GDPR.

Retention periods

Business records relevant for tax purposes are generally retained for seven years; records covered by OSS are retained for ten years. Pending proceedings or other legal obligations may require longer retention. Contract and delivery evidence remains stored for as long as necessary for contract performance, existing download entitlements or the protection of legal claims. Where no such reason exists, data is deleted on an erasure request and during record reviews. There is currently no automatic deletion routine.

A cancellation or refund may block downloads but does not automatically delete records required for tax or contractual purposes. Purely demo orders do not generate invoices for real sales. Erasure requests can be sent to office@marco-hesina.at . Deleting browser data does not delete orders stored on the server.

Your rights

Subject to the legal requirements, you have rights of access, rectification, erasure, restriction of processing and data portability. Where processing is based on consent, you may withdraw that consent at any time with future effect. This does not affect the lawfulness of processing carried out before withdrawal.

Right to object: Where processing is based on legitimate interests, you may object on grounds relating to your particular situation.

You may also lodge a complaint with a data protection supervisory authority, in particular the Austrian Data Protection Authority, Barichgasse 40–42, 1030 Vienna, dsb@dsb.gv.at. We do not make automated decisions about you that have legal or similarly significant effects.

Security check by Cloudflare

Cloudflare Turnstile processes technical browser signals to detect automated access. Cloudflare provides information about this processing and its configuration-dependent use of security storage in its Turnstile privacy notices . Further information is available in the section Privacy policy.

Managing storage

You can delete or block cookies and website data for marco-hesina.at in your browser's privacy or site settings. This removes saved carts and the display of your last order and ends administrator login. If session cookies are blocked, checkout and the administration area may not work.

Save any downloads you need beforehand. Deleting browser data does not delete an order already stored on the server. For this, you can contact office@marco-hesina.at .

General terms and conditions

Save the terms and withdrawal information as a text file (German) ↓

1. Provider and offering

The beat provider and licensor is Marco Hesina, Breitweg 6i / Top 33, 6060 Hall in Tirol, Austria; office@marco-hesina.at; phone +43 676 733 21 59; VAT ID ATU82866427. These terms govern the selected music licence and digital delivery through marco-hesina.at. For a purchase labelled Sold through Link at checkout, Stripe Managed Payments handles the sale through Link as merchant of record; the specific seller entity and its purchase and payment terms are identified at checkout. Marco Hesina remains responsible for the music licence, files and product-related support. Without this label, the purchase is made directly from Marco Hesina. Individual studio services are agreed separately. The contractual language for our licence and delivery terms is German.

2. Selection, corrections and contract formation

Before ordering, you can play the preview, read the licence terms and PDF preview, select a licence, and change your cart and details. Continue to payment takes you to the payment page of Stripe or Link. There you can review the seller, billing details, taxes, currency and total price, and cancel before final payment. Clicking the final button explicitly labelled as a payment submits a binding order. For a direct purchase from Marco Hesina, the contract is formed upon successful payment and our contract confirmation by email. For Sold through Link, purchase completion and payment processing are governed by the terms displayed there; Marco Hesina then confirms the selected licence and delivery by email. Failed or cancelled payments do not entitle you to download. There is no subscription or automatic renewal.

3. Prices, tax, payment and invoices

Catalogue prices are final prices in euros, including applicable taxes. Checkout displays the payment currency available to you, any currency conversion, applicable taxes and the final total. Tax treatment depends on billing details, the product and applicable rules; the information at checkout and on the invoice is authoritative. There are no shipping charges. Payment is due immediately and uses the payment methods offered there. For Sold through Link, Link emails the payment receipt, invoice and any refund documents; you can also contact Link support with payment and refund questions. The company and tax details shown on the invoice depend on the transaction. For direct sales, Marco Hesina provides the invoice electronically through Stripe. By ordering, you agree to receive purchase documents and our licence and delivery confirmation electronically.

4. Digital delivery and technical requirements

The items delivered depend on the selected variant: the master without a voice tag, the personal licence document as a PDF and, only for variants expressly labelled as including them, the stems as a ZIP archive. The master file format is shown in the store. No physical storage medium is shipped. You need internet access, a current browser, sufficient local storage and suitable software for the specified audio format, PDF and, where applicable, ZIP. Music editing requires compatible audio software. The delivered files have no technical copy protection; download access is protected by a personal link.

Personal download links are activated after payment is confirmed and our licence and delivery confirmation is sent. This happens immediately when payment and email processing work correctly. In the event of a technical delay, the order remains stored; do not pay again and contact us with your order number. Download the files and keep them safely with the contract documents. A customer account is not required. Our email contains the ordered licence terms, these terms and conditions, your declarations regarding immediate download and the personal access link. For Sold through Link, you also receive the purchase and invoice documents from Link. The ordered terms are saved, and later edits in the store do not change them for your purchase. You can retain your contract through the emails and personal licence PDFs. Do not share personal download links with third parties.

5. Usage rights

The nature and extent of the usage rights granted are governed by the terms of the specific licence selected, which are available before purchase. These state, in particular, any usage limits, credit requirements and permitted releases. An Exclusive licence does not retroactively terminate valid earlier licences. After an exclusive sale, the beat is no longer offered for purchase. Downloading the file does not transfer copyright. Additional rights arise only where expressly agreed.

6. Defects and mandatory rights

Statutory warranty rights apply, in particular the provisions of the Austrian Consumer Warranty Act applicable to digital content. For missing or defective files, contact us at office@marco-hesina.at with your order number. These terms do not exclude statutory rights to have conformity restored, a price reduction, termination of the contract or compensation. Mandatory consumer protection rights in the country of your habitual residence remain unaffected.

8. Demo and test orders

A checkout expressly labelled as a demo or Stripe test is free of charge. Test amounts are not actually collected; no music usage rights are granted and no tax invoice for a real sale is issued. Test and demo licence documents are labelled accordingly. In Stripe test mode, use only test card details. You can request cancellation of a free demo order at office@marco-hesina.at. Statutory data protection and consumer rights remain unaffected.

Withdrawal & cancellation

Withdraw from contract ↗

7. Withdrawal information for consumers

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the date on which the contract is concluded.

To exercise the right of withdrawal, you must inform Marco Hesina, Breitweg 6i / Top 33, 6060 Hall in Tirol, Austria, office@marco-hesina.at, phone +43 676 733 21 59, of your decision by an unequivocal statement, for example by email or letter. You may use the form below, but this is not mandatory. The online Withdraw from contract function is also available at marco-hesina.at/store/withdrawal.php. Enter the details needed to identify your contract and submit the statement with Confirm withdrawal. We promptly acknowledge receipt by email, including the content, date and time. To meet the deadline, it is sufficient to send your statement before the withdrawal period expires. These options remain available regardless of whether your right of withdrawal has already expired in the particular case; receipt alone does not determine legal validity.

In the event of a valid withdrawal, payments received for this contract will be reimbursed without undue delay and no later than 14 days after we receive your statement. Reimbursement uses the same payment method as the original payment unless expressly agreed otherwise; no fees are charged for this. For a purchase processed through Link, you may also declare withdrawal to the seller identified at checkout through Link support. If we receive a statement about such a purchase, we identify the transaction and arrange further processing through Stripe or Link. Our online function remains available as a contact option; it does not restrict mandatory consumer rights.

Special rule for digital content supplied immediately: your right of withdrawal expires early only if, before supply begins, you expressly consented to performance beginning before the end of the 14-day period, acknowledged that you thereby lose your right of withdrawal, received the legally required contract confirmation including these declarations, and contract performance has begun. Consent is requested separately at checkout and is not preselected. Statutory warranty rights remain in place.
